In 2024, energy companies experienced a notable uptick in federal securities class action complaints, witnessing 15 new cases, according to a report by Baker Botts. This rise indicates the increased scrutiny the sector is facing in light of significant incidents and volatile market conditions. Such litigation frequently follows stock price declines, often triggered by regulatory actions, environmental occurrences, or operational delays.
Jim Beha, a partner at Baker Botts in New York, highlights that the energy sector accounted for nearly 7% of the 219 securities class action complaints filed last year. Interestingly, a majority of these cases stem from unique adverse events rather than traditional financial misstatements. Energy defendants tend to see favorable outcomes more often than in other sectors, with 43% of cases dismissed outright and approximately 39% settled, a pattern consistent over the past decade.
The complexity and duration of these cases are evident, as seen in a notable settlement secured by Robbins Geller Rudman & Dowd LLP and Entwistle & Cappucci, amounting to $126.3 million during a multi-week trial involving the now-bankrupt Alta Mesa.
