The case alleged that Abbott’s formula resulted in the death of a premature infant. The trial was part of a broader legal action involving over 700 lawsuits that claim the formula is linked to necrotizing enterocolitis (NEC), a serious gastrointestinal illness. Despite dismissing this bellwether case, Judge Pallmeyer has allowed the plaintiffs’ general causation experts to proceed in these numerous lawsuits.
