The American Bar Association (ABA) has filed a motion to dismiss a lawsuit brought by the American Alliance for Equal Rights (AAER), which alleges that the ABA’s Legal Opportunity Scholarship Fund discriminates against white applicants. Established over two decades ago, the Legal Opportunity Scholarship awards $15,000 to 20-25 incoming law students annually. Eligibility is limited to members of underrepresented racial and ethnic minority groups, including African American, Native American, Hispanic, and Asian/Pacific Islander students. The AAER, led by Edward Blum, asserts that this criterion unlawfully excludes white students, violating 42 U.S.C. §1981, a federal statute that guarantees all individuals the right to make and enforce contracts regardless of race.
In its defense, the ABA maintains that the scholarship program is a discretionary gift, not a contract subject to federal anti-discrimination laws. The association also argues that the plaintiff lacks standing, as the anonymous white applicant did not make a concrete effort to apply for the scholarship. Furthermore, the ABA emphasizes its commitment to diversity and equal participation within the legal profession.
This lawsuit is part of a broader trend of legal challenges against diversity initiatives. In 2024, the ABA revised its Judicial Clerkship Program criteria to remove references to minority students after facing legal threats from conservative groups. Additionally, the AAER has previously filed lawsuits against major law firms’ diversity fellowships and other organizations’ scholarship programs, alleging similar claims of racial discrimination.
