Federal Circuit Court to Review KUS Technology’s Appeal in $50 Million Patent Infringement Ruling

KUS Technology Corp. is petitioning the U.S. Court of Appeals for the Federal Circuit to overturn a nearly $50 million judgment imposed by a Wisconsin federal court for alleged infringement of a fuel tank sensor patent held by competitor SSI Technologies.

The dispute centers on SSI’s U.S. Patent No. 9,535,038, which pertains to sensors designed to determine fluid characteristics within containers, such as fuel tanks. SSI initiated legal action against KUS, asserting that KUS’s sensors infringed upon this patent. The district court ruled in favor of SSI, leading to a substantial damages award against KUS.

In its appeal, KUS contends that the district court’s claim construction was flawed, particularly regarding the term “filter” in the patent claims. The district court had construed “filter” to mean “a porous structure defining openings, and configured to remove impurities larger than said openings from a liquid or gas passing through the structure.” KUS argues that this interpretation was overly broad and did not align with the patent’s specifications, leading to an erroneous finding of infringement.

This case underscores the critical importance of precise claim construction in patent litigation. The Federal Circuit’s forthcoming decision will not only impact the parties involved but may also provide further guidance on the standards for claim interpretation and the assessment of damages in patent infringement cases.
