Georgia’s StarChem LLC Seeks Summary Judgment in Trademark Dispute with Florida Rival

Georgia-based chemical company StarChem LLC has petitioned a federal judge for an early judgment in its trademark infringement lawsuit against Florida competitor StarChem USA LLC. The plaintiff contends that neither the defendant nor its affiliated Chinese entity can substantiate prior use of the disputed trademark.

In October 2023, StarChem LLC initiated legal proceedings, alleging that StarChem USA LLC adopted a similar name and design mark to boost its sales. The lawsuit, filed in the U.S. District Court for the Middle District of Georgia, accuses the Florida company of trademark infringement, asserting that the resemblance between the two companies’ names and logos could lead to consumer confusion and damage StarChem LLC’s brand reputation.

StarChem LLC’s recent motion for summary judgment argues that StarChem USA LLC and its Chinese sister company have failed to demonstrate any legitimate prior use of the contested trademark.
