Bronx Defenders Attorney Faces Ethical Dilemma Amid Court Mandate and Ongoing Labor Strike

An attorney from the Bronx Defenders found herself caught in a difficult situation when she was compelled to cross the picket line amid an ongoing labor strike. This predicament arose after an immigration judge mandated her presence in court, despite her engagement in the strike, and management did not assure that the proceedings would continue in her absence.

The Bronx Defenders’ union representative disclosed that the judge’s demand came under the threat of reporting the attorney to the ethics board if she failed to appear. This decision occurred concurrently with management declining a postponement request for the hearing. As revealed in recent coverage, management insisted that, should the attorney attend, her return to work must be unconditional.

The labor strike, which began on July 27, stems from unresolved issues in contract negotiations, particularly over salary scales. The union representing the Bronx Defenders seeks to maintain pay parity between attorneys and social workers, while leadership contends that appointing divergent salary scales is necessary to improve recruitment and retention of lawyers. The union proposed a solution offering a differential for attorneys, but management rejected this, pushing for separate scales.

Negotiations have been marked by both parties offering compromises. The union agreed to discussion points such as differentials and noncitizen protections, proposing a combined salary of $95,000 for attorneys to preserve parity. Despite these efforts, the management held fast to its stance, leaving the situation unresolved.

This strike is part of a broader action involving unions under the Association of Legal Advocates and Attorneys, affiliated with the United Auto Workers. Legal services across New York City have been affected, with the Brooklyn Defender Services Union and Neighborhood Defender Services union concluding their strikes after reaching agreements.
