The patent in question, U.S. Patent No. 11,216,805, issued on January 4, 2022, pertains to methods for managing and reconciling complex, multi-party digital payment transactions. ModoPayments asserted that Volvo’s ‘VolvoPay’ platform, which reportedly went into production around December 2021, infringed upon this patent. The company claimed to have notified Volvo of the patent in February 2022, with the alleged infringement commencing in October 2022 after the termination of their agreement.
In his decision, Judge Gregory B. Williams dismissed the patent infringement claims, effectively narrowing the scope of the lawsuit. However, the court permitted the copyright infringement claims to move forward, indicating that ModoPayments’ allegations regarding the unauthorized use of its copyrighted material warrant further examination.
