The Second Circuit has granted high-end fashion brand Mackage an opportunity to press its allegations against competitor Rudsak USA Inc. over supposed misappropriation of proprietary information. This decision, delivered on Tuesday, partially resuscitates Mackage’s lawsuit.
Mackage claims that Rudsak USA Inc. unlawfully used its proprietary information, leading to a legal battle over the allegations. The recent decision by the Second Circuit has breathed new life into these accusations, granting Mackage another chance to present its arguments before the courts.
However, the appellate court upheld a previous ruling by a Manhattan federal judge, who correctly dismissed Mackage’s claims of trade dress infringement and dilution. The Second Circuit agreed that these specific claims lacked validity, further detailing its analysis and reasoning in its written opinion.
As the case returns to the lower court following this partial revival, both Mackage and Rudsak will have to prepare for another round of arguments, focused, this time, solely on the allegations surrounding the misuse of proprietary information.
