In a recent judgment, the Federal Circuit overruled a decision put forth by Western District of Texas Judge Alan Albright concerning a patent infringement lawsuit against Zebra Technologies Corp. According to the initial ruling, the plaintiff was understood to lack constitutional standing to press charges for patent infringement.
Upon review, the Federal Circuit came to a different conclusion, stating that under a loan agreement, the plaintiff still holds patent rights. In light of this, the original case which was previously dismissed on the grounds of lack of standing, has now been revived.
