FTC’s Noncompete Agreement Ban Faces Controversy; Experts Propose Paid Alternatives

A recent rule issued by the Federal Trade Commission (FTC) in April, which aims to ban nearly all noncompete agreements nationwide, has sparked significant controversy and legal challenges. According to Steven Kayman at Rottenberg Lipman, a more effective alternative to this sweeping prohibition would be implementing a nationwide rule that mandates employers to compensate employees during the noncompete period. This proposal suggests that paid noncompetes could balance the interests of both employers and employees more fairly and could mitigate some of the issues critics have with the current FTC rule.
