Qorvo Awarded $11.7 Million in Legal Fees Over Akoustis Trade Secret Misappropriation



Qorvo Inc. has secured an award of $11.7 million in attorneys’ fees following a trial in May that concluded Akoustis Technologies Inc. had willfully misappropriated its trade secrets and infringed upon its wireless technology patents. This decision was rendered in a recent order from U.S. District Judge Jon P. McCalla in the District of Delaware.

Initially, Qorvo had sought over $12.1 million in legal fees under the Defend Trade Secrets Act (DTSA), which permits such awards in instances of willful and malicious misappropriation. However, Judge McCalla’s ruling adjusted the amount, particularly reducing the claims for travel time by Qorvo’s legal team.

This legal battle originated in October 2021 when Qorvo filed the lawsuit against Akoustis, alleging that the rival startup had improperly utilized its trade secrets in the development of radio frequency filters.
